This Privacy Policy applies to Elan Travel Ltd. and the employees in its three offices in Kitimat, Terrace and Prince Rupert including our website www.elantravel.ca. and relates to the “personal identifiable information” of clients who deal with Elan Travel and its staff. “Personal identifiable information” includes personal information normally provided by or on behalf of a prospective traveler to a corporate or vacation travel consultant or on www.elantravel.ca, about that particular traveler as well as other parties traveling with that traveler, in order to make travel reservation(s) or for marketing purposes. Such information usually includes the traveler’s name and phone number. It can also contain any other data entered into our computerized system by the consultant including but not limited to address, email address, passport number, frequent flier number, dietary preferences, special needs, etc.

Elan Travel is committed to the on-going protection of your privacy and the confidentiality of your personal identifiable information. This privacy policy:

The Act identifies ten governing principles that relate to privacy rights. Addressing each of them in turn allows Elan Travel to outline in detail the procedures it has adopted as part of our privacy policy.

1. Accountability

Personal identifiable information is shared with third party suppliers to complete the client’s reservation and we endeavour to work with those who adhere to “the Act.” Customers who choose to communicate with Elan Travel via insecure means of communication do so at their own risk. Elan Travel is not responsible for the privacy practices of any websites which is connected by hyperlink.

2. Purpose for Collection

Elan Travel receives personal identifiable information provided by vacation or corporate clients or a designate. It is used for:
a) facilitating reservation transactions, including third party suppliers, credit card company, etc.,
b) informing you about products and services that Elan Travel believes may be of interest to you,
c) to develop products and services,
d) analyzing business results, to better manage our operation, and
e) acting as required or authorized by law.

In addition, Elan Travel receives personal identifiable information from its website. Some of it is voluntarily provided and some of it is based on “cookies” that are common in Internet usage. Normally, you can visit our website without communicating any personal identifiable information, and are encouraged to do so. However, if you wish to take advantage of some aspects of our website (e.g. promotions, newsletters, etc.) you will be asked to submit specific personal identifiable information. By providing it, you are consenting to our use of it.

In visiting our website, you leave information about your visit (e.g. time of day, length of visit, pages viewed, etc.). This information is anonymous and does not include personal identifiable information. It is used, usually after being aggregated, in order to improve the Elan Travel’s website.

Elan Travel can also track the web pages that are visited by placing a “cookie” on your hard drive. It is transferred by a Web server to your browser, and can be read only by the server that provided it in the first place. Cookies do not reveal personal identifiable information, nor can it read data from your hard drive. The only information it contains is that which you yourself provide. You are free to visit the site with “cookies” turned off, but may find that some attributes of the Elan Travel site are inaccessible or unusable as a result.

3. Consent

Personal identifiable information collected by Elan Travel is collected in compliance with this privacy policy. As such, it can be collected only with your knowledge and consent or in compliance with the Act.

Your consent can be obtained in a variety of ways. It may be obtained expressly, or it may be determined from the circumstances that your consent can be implied. In particular, consent will be implied whenever you have responded to Elan Travel in regard to a product or service, or via a means of communication from which it is reasonably apparent that you have seen references to the existence and availability of this privacy policy. Specifically, Elan Travel believes that you expect to be advised of new or existing products or services that seem to be relevant to you and your disclosed interests; see paragraph 2(b) above.

Your consent can be withdrawn or modified, through your provision of reasonable notice in writing to your corporate or vacation travel consultant or the Elan Travel Privacy Officer. This may result in your reduced access to the benefits offered by Elan Travel.

From time to time, Elan Travel will rely upon trusted third party suppliers, or strategic alliance partners, to provide certain services. Each must have a privacy policy that complies with the Act. Personal identifiable information will be relayed to such companies and your consent to this is implied.

Consent will be implied when a legal guardian or person having power of attorney is making travel arrangements for a minor, someone seriously ill or mentally incapacitated.

Your consent will also be implied to Elan Travel's disclosure of personal identifiable information to Elan Travel's lawyer, to police and similar authorities, to any other person authorized by the Act, and in an emergency situation in which your life, health and safety is in danger.

4. Limiting Collection

Elan Travel collects and uses personal identifiable information in accordance with the Act for the purposes set forth in this privacy policy and will not collect this information indiscriminately.

5. Limiting Use, Disclosure and Retention

Your personal identifiable information will be used only for the purposes and in the ways, outlined in this privacy policy, or as otherwise authorized by the law.

Elan Travel discloses personal identifiable information to the extent necessary or related to successfully completing the reservation.   Thus, information is disclosed to the travel suppliers selected by the traveler and others involved in the transaction, such as the traveler’s credit card company, insurance company, and otherwise as necessary on important public interest grounds or as required by law, court order, or as requested by a governmental or law enforcement authority or in the good faith belief that disclosure is otherwise necessary or advisable.

Personal identifiable information is retained until:

a) the last day that Elan Travel is required by law to retain it
b) the last day Elan Travel reasonably believes it needs to be retained in order to allow you to access it in the event that it affected a decision involving you, and
c) the day it is no longer required to be retained in conjunction with the purposes listed in section 2 above, unless you have earlier requested in writing that such data be disposed of.

Personal identifiable information may be destroyed, erased, shredded or otherwise discarded.

6. Accuracy

Elan Travel is committed to accuracy in the collection and use of your personal identifiable information. It assumes that such data is correct when provided by you, or on your behalf. You are invited to review (and notify of any apparent errors in) your own personal identifiable information by first contacting the Privacy Officer at Elan Travel. In the absence of such notification, personal identifiable information will be assumed to be accurate as is and when received. If advised of errors in personal identifiable information that sources from a third party, Elan Travel will direct you to that third party for rectification of your records.

You are invited to view and update your personal identifiable information. Elan Travel assumes no responsibility for such up-dating except in response to your specific request.

7. Safeguards

Personal identifiable information is secure with Elan Travel. All personal identifiable information that is collected by Elan Travel is safeguarded with appropriate security measures that are consistent with this industry and the technology that is currently available. Measures are in place to protect against loss, theft, unauthorized access to, or unauthorized use, disclosure, copying, or modification of personal identifiable information.

8. Openness

Elan Travel’s privacy policy is readily available to clients and employees, and the Privacy Officer will respond promptly to specific inquiries with respect to it.

9. Individual Access

If you wish to view the personal identifiable information that Elan Travel has received about you, please contact our Privacy Officer as outlined in paragraph 1 above. In all cases, a written request will be required, and you may be asked to provide photo identification in order to ensure that Elan Travel does not inadvertently release personal identifiable information to an inappropriate party.

In the unlikely event that a request for access is refused, you will be provided with written reasons for the decision from the Privacy Officer.

You are free to challenge the accuracy or completeness of the personal identifiable information, upon provision of evidence in support of your challenge, and if required Elan Travel will correct or amend the personal identifiable information.

10. Challenging Compliance

In the event that you believe that Elan Travel is violating the Act, or this privacy policy, please provide details in writing to the Privacy Officer. Elan Travel will investigate and provide as soon as reasonably possible a written response. In the event that such challenge is meritorious, Elan Travel will amend its practices and policies accordingly.
